The YBSGO mobile application (hereinafter referred to as "the Application") is jointly created by GO Transit and YBS Explorers. We embarked on this journey with the goal of improving the bus riding experience for the residents of Yangon by providing accessible and reliable public transportation information. By downloading, installing, or using this Application, you are deemed to have read, understood, and agreed to be bound by the following comprehensive terms and conditions. If you do not agree with any part of these terms, you must not use the Application.

1. Purpose of the Application

YBSGO is designed to serve as a helpful, user-friendly tool for navigating Yangon's public transportation system. It specifically aims to provide detailed information on bus routes, bus stops, and estimated travel times in an offline map format. Our objective is to empower commuters with the necessary information to plan their journeys efficiently and enhance their overall bus riding experience within Yangon. The Application is intended for general informational purposes only and should be used as a guide.

2. Access and Usage

This Application is provided to you completely free of charge. There is no requirement for account creation, registration, or any form of payment to access or utilize its features. YBSGO is designed to function primarily as an offline map application, meaning you can access its core functionalities, such as viewing bus routes and stops, even without an active internet connection. While the app is free, you are responsible for any mobile data charges that may apply if you choose to use features that require an internet connection (though such features are minimal in this offline-focused app). The Application is intended for personal, non-commercial use only.

3. Accuracy and Reliability of Information

We make every reasonable effort to ensure that the information presented within the Application (including, but not limited to, bus routes, stop locations, and operational details) is accurate, up-to-date, and reliable. However, public transportation systems are dynamic and subject to frequent changes, including route modifications, temporary diversions, schedule adjustments, and unforeseen disruptions. Therefore, GO Transit and YBS Explorers cannot guarantee the absolute completeness, accuracy, or timeliness of all information at all times. Users are strongly encouraged to exercise their own discretion and, whenever possible, reconfirm the latest information through official sources or local announcements before commencing their journeys. Your reliance on the information provided by the Application is solely at your own risk.

4. Non-Affiliation and Independence

YBSGO is an independent initiative developed by GO Transit and YBS Explorers. It is not directly affiliated with, endorsed by, sponsored by, or otherwise officially connected to any government entity, public transportation authority, private bus operator, or any other organization. Our singular and unwavering purpose is to contribute positively to and support the public transportation system of Yangon, Myanmar, for the benefit of its residents. The views and information presented in this Application are solely those of GO Transit and YBS Explorers.

5. User Responsibilities and Prohibited Conduct

By using the Application, you agree to use it responsibly and lawfully. You are solely responsible for your conduct while using the Application. You agree not to:

Use the Application for any illegal, unauthorized, or unethical purpose.

Attempt to interfere with, disrupt, or compromise the integrity or security of the Application or its underlying systems.

Engage in any activity that could damage, disable, overburden, or impair the Application or the servers and networks connected to the Application.

Attempt to gain unauthorized access to any portion of the Application or any other accounts, computer systems, or networks connected to the Application.

Copy, modify, distribute, sell, or lease any part of our Application or its content, nor may you reverse engineer or attempt to extract the source code of the Application, unless laws prohibit those restrictions or you have our written permission.

Use the Application in a manner that could harm minors.

Transmit any material that is offensive, defamatory, obscene, or otherwise objectionable. Your adherence to these responsibilities ensures a positive experience for all users.

6. Intellectual Property Rights

All content, features, and functionality within the Application, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and the compilation thereof, are the exclusive property of GO Transit and YBS Explorers or their respective licensors, and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. Your use of the Application grants you no rights to the intellectual property of the Application or its content. Any unauthorized use, reproduction, distribution, display, or creation of derivative works based on the Application's content is strictly prohibited without our express prior written permission.

7. Limitation of Liability and Disclaimers

THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. GO TRANSIT AND YBS EXPLORERS DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF INFORMATION. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

IN NO EVENT SHALL GO TRANSIT AND YBS EXPLORERS, THEIR DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APPLICATION; (III) ANY CONTENT OBTAINED FROM THE APPLICATION; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

8. Changes to Terms and Conditions

We reserve the sole right to modify or replace these Terms of Use at any time, at our discretion. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the Application.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Republic of the Union of Myanmar, without regard to its conflict of law provisions. Any legal action or proceeding relating to your access to, or use of, the Application or these Terms shall be instituted in a court located in Yangon, Myanmar.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. The invalid or unenforceable provision will be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.

11. Entire Agreement

These Terms constitute the entire agreement between you and GO Transit and YBS Explorers regarding our Application, and supersede and replace any prior agreements, oral or otherwise, regarding the Application.
